Abstract [en]

This bookexplains the origins, structure and functioning of the European Convention on Human Rights, and its position in the overall system of protection of humanrights in Europe. It discusses and analyses the composition, functions andprocedure of the Court of Human Rights. It clarifies the scope of each of therights and freedoms laid down by the Convention by reference to the case law of the Court. It also explains the status and impact of the Convention in Swedish law and in the law of the European Union. It provides a detailed guide to research sources and methodology for those wishing to investigate human rightsissues under the Covention in more detail

Abstract [en]

In this article, I examine the issue of competing human rights from a legal perspective. European states which are members of the European Union (EU), are bound by three different sets of legally binding rights catalogues, or “rights regimes”; the EU Charter on Fundamental Rights and Freedoms (“Charter”), the European Convention on Human Rights (ECHR) and national, constitutional, rights catalogues. Freedom of religion is recognized as an important right and protected by the ECHR (Article 9), the Charter (Article 10) and almost every national rights catalogue. What then is the problem, apart from the obvious one that the law can say one thing, but the practice at the national level can be quite different? The problem is that freedom of religion can compete with other rights within the same rights regime, and, moreover, competition can arise between the regimes.

Abstract [en]

The development of EU sanctions has given rise to a range of difficult issues in several fields. The focus of this article is the challenges administrative and criminal (and administrative/criminal) procedure face when intelligence material is led as evidence. The use, or attempted use, of secret evidence in proceedings before the Court of Justice of the EU attempts to balance security concerns with the right to a fair trial. The proposed system poses considerable risks to the right of fair trial.
