Abstract [en]

The purpose of the present study is to investigate fundamental issues related to refugee protection, with particular reference to the protection of people fleeing armed conflicts, under international and EU law. The author provides a comprehensive legal analysis of relevant substantive law, along with an examination of the settled case-law of the Court of Justice of the European Union and the European Court of Human Rights. The traditional legal method implemented in this study is based on diverse sources, such as international and regional instruments, i.e. treaties and conventions, along with international customary law and EU primary and secondary legislation. The overall outcome of this analysis is that fundamental discrepancies exist between the protection regime provided by international law and EU law instruments, particularly with regard to people fleeing armed conflicts.
