Abstract [en]

Recent years in Europe has been turbulent. Economic crises have been followed by migration crises and a rise of far-right political movements. In addition, some Member States in eastern parts of the Union have been in the spotlight recently due to Rule of Law related issues.  

The EU, in order to combat a disregard for the Rule of Law, initiated the so called “Rule of Law Framework” with hopes to avoid having to use the infamous Article 7 TEU or as it is also known, the nuclear option.

This thesis aims to analyse and evaluate the effectiveness of EU’s Rule of Law Framework as well as Article 7 TEU in light of the constitutional crises currently occurring in Hungary and Poland.
