Study on the New and Old Problems in EU Moral Rights Protection in Related with Economic Rights Expired Works

Abstract [en]

This thesis is about the problems in moral rights protection in the European Union. It has been considered as a conflict part between copyright and the public domain due to the limitation on the free use and perpetual protection of moral rights protection in some member states. This thesis is going to discuss the moral rights legislation on the perspective of the whole EU, by using the literature research, the literature analyses and comparing the current EU moral rights protection by the method of Data Visualization. Thesis mostly focuses on the Lack of harmonizing in the aspect of (1) duration of protection; (2) scope of rights protected; (3) moral rights and protection obligation inherit; (4) terminology. And choose France, Italy, and Germany to do a more detailed comparison. The study will also discuss the new problems on moral rights caused by the fast development of information technology and digital environment, including (1) the loss of control on author’s reputation and the integrity of the work; (2) the difficulties brought by the development of applications; (3) cause a much larger harm among author due to the broader dissemination. It will also discuss the importance of moral rights on the perspective of both author’s individual rights protection and public domain protection.
