Abstract [en]

This thesis concerns the harmonisation (or lack thereof) of moral rights in the European Union. In the absence of EU regulation, the protection of moral rights vary significantly in the national laws between Member States, in particular between countries of common- and civil law. As of yet, the EU Commission has no intentions of harmonising the moral rights protection in the EU. The main argument for this is due to lack of significant effect on the functioning of the Internal Market. However, moral rights have been recognised as particularly important for the protection of authors and their works in the digital environment. Although these are not economic in nature, they do have an obvious economic impact. Therefore, many European scholars are demanding that they be harmonised at EU level.
