Abstract [en]

Cross-border disputes are an unavoidable corollary to transnational free movement in the EU:s internal market, based on the four economic freedoms of free movement of goods, services, people and capital. Nevertheless, EU competence in the field of civil justice was established only in 1999. The Union has since taken considerable measures aimed to both facilitate cross-border judicial cooperation and to create common procedures. However, the policy area has so far not been able to fulfill its ambitions. Full mutual recognition of judgments between member states has encountered challenges where the goal of effective enforcement clashes with fundamental rights. In addition, because of cultural differences between the member states and the limitations of the EU competence, the development in the field has been criticized for being fragmented. The chapter describes a policy area that is growing fast and still struggling to find its identity.
