Abstract [en]

Sweden has repeatedly been criticized for its detention periods. It’s noteworthy that thisoccurs in Sweden, since it’s considered as a country with a strong uphold of human rights andlegal certainty.However, there is a clear conflict of values regarding Swedish detention periods. On the onehand, detention is a major coercive intervention for an individual, especially in cases wherethe individual is subjected to restrictions. On the other hand, detention is often necessary forlaw enforcement authorities to make use of, in order to investigate crime.By using a methodological structure of a qualitative idea analysis, the main arguments in thedebate regarding the long detention periods in Sweden will be distinguished and described.Moreover, the arguments will be analyzed in relation to the rule of law in order to investigatewhether Sweden’s actions are compatible with these.At last the results present that there is no unambiguous solution regarding the long detentionperiods, based on the principles of the rule of law. Although it can be stated that despite therepeated criticism directed at Sweden, it still seems permissible that the interest in lawenforcement may weigh heavier than the principles on which the rule of law rests.
