Between Law and Ethics in the Digital World : The Social Corporate Responsibilies of Internet Service Providers regarding Information Freedom and Privacy (English)
The main purpose of this master thesis is to explore the social corporate responsibilities regarding information freedom and privacy, held by the internet service providers.
In 2005 Shi Tao was sentenced to ten years in prison for leaking state secrets abroad. Yahoo! provided the Chinese Security Bureau with information about Shi Taos user data. This case highlights the challenge internet service providers meet when they are operating in countries with domestic laws and regulations that violates the users rights of privacy and information freedom.
With the theory and method of socialconstructionism, discourseanalysis and Manuel Castells thoughts I examine the debate wich followed after the publishing of the news about Shi Tao by Reporters Without Borders. The main question for this part of the analysis is ” What is the relationship between the corporate social responsibility and the internet service providers reputation”.
The thesis shows that corporate social responsibility is very important for the companies reputation. It is however unclear whether the corporate principles and values will be effective in preventing further violation of users´ privacy and right to information freedom. The corporate view is that the responsibilty mainly lies on a government to government level.
The second part of the analysis examines the concept of ”privacy” I also study how internet service providers new technology has forged advertisment and information into the same system. The main question for this part of the analysis is ”How does the internet service providers access to user data affect users privacy?” The thesis shows that it can have an great impact on users privacy and that this is an important question that would need more attention in today debate, in Sweden as well in other countries.
