2008 (English)In: Japanese and European Private International Law in Comparative Perspective / [ed] Jürgen Basedow, Harald Baum, Yuko Nishitani, Tübingen: Mohr Siebeck , 2008, 317-343 p.Chapter in book (Other academic)
Abstract [en]

The article provides a compehensive analysis of the European Union's Brussels II bis Regulation in respect of divorce. The Regulation's rules on jurisdiction and recognition of judgments on divorce are analyzed and exemplified. The article is critical towards the need of any unified choice of law rules regrading divorce. Finally, the article focuses on the so-called foreign law problem, which should be given far more attention within the EU also in the field of divorce law.
