Another year passed in the annals of Swedish tort law history. Of particular comparative interest, some issues regarding State liability are worth mentioning in this Yearbook. Actually all the cases dealt with below are examples of the legal problems as regards liability for wrongful legalapplication of legal rules in courts or other authorities. The question that the Supreme Court had to give an answer to was: ‘How should the wrongful legal interpretation be qualified in order to establish a necessary level of “negligence”, so that the State will be liable for damages arising from the decision?’ Therefore, the title – or subheading – of this article should read State Liability for Errors of Law by Courts or other Authorities.
