There are two established theories on the so-called incidental question (also called "preliminary issue) of Private International Law, namely the lex fori-model and the lex causae- model. These are examined against the background of Swedish legislation and case law on formalised same-sex relationships and Muslim marriages. Both theories appear to enjoy support in Swedish law. Whatever model is chosen appears to depend on what best serves the legislator's or court's notion of a desirable result.
