Abstract [en]

The article scrutinizesthe recent developments of the legal frame-work as to pension fund investment allocations to private equity in the EU, including the proposal of changes to Directive 2003/41/EC on the activities and supervision of institutionsfor occupational retirement provision(IORP Directive). This article investigates how pension fund allocations in risky assets should be regulated and whether introduction of the Solvency II regulation to pension funds is a proper policy response to this problem.It con-cludes with a warning as to the application of the capital funding requirements to pension funds, as it envisaged by the proposal to the art.17 of the IORP Directive.
