EU Sanctions and Defence Rights

The development of EU sanctions has given rise to a range of difficult issues in several fields. The focus of this article is the challenges administrative and criminal (and administrative/criminal) procedure face when intelligence material is led as evidence. The use, or attempted use, of secret evidence in proceedings before the Court of Justice of the EU attempts to balance security concerns with the right to a fair trial. The proposed system poses considerable risks to the right of fair trial.
