    Abstract [en]

    Crises, while unforeseen and exceptional, appear with some regularity. Cri-sis management is not exceptional, but a recurring task. This paper studies the impact of international law on how international crises are handled and the room allowed for emergency measures within international legal dis-courses. It outlines the relationship between an extra-legal exceptionalist perspective, where law is considered an obstacle to emergency measures, and a more constitutionalist one, where exceptional measures are included within the legal paradigms. Examples are drawn from two contemporary crises: the global financial crisis, with particular reference to Iceland and the Icesave dispute, and the treatment of global epidemics and its effect on trade, with particular reference to the pandemic swine influenza A (H1N1). It is suggested that many factors seem to influence the choice of perspec-tive: inter alia previous deviations in similar situations and the institutional solidity of the legal environment of the rule in question. The role for inter-national law in crisis may increase through soft law guidance and persuasive advice from credible organisations that may assess the gravity of the situa-tion and suggest alternative courses of action within the ambit of law.

    Abstract [en]

    This article studies the effects of invoking international necessity, to see whether it can be reconciled with an aspiring international rule of law. Any field of application in theory possible, the doctrine is here applied to uses of force, illustrated by humanitarian interventions, actions against international terrorism and the 2004 Construction of a Wall case. Relationships between circumstances precluding wrongfulness and the grounds for treaty termination is examined in light of international practice, studying necessity's impact on the stability of treaty regimes. The author concludes that international tribunals when applying necessity generally heed the rule of law, the stability of treaties and the elevation of overriding norms. Necessity, if successfully invoked, is not perceived to alter substantive obligations. It cannot create a right to assume would-be illegal behaviour. As a result, necessity need not threaten international legal regime building, but may serve as a safety valve, allowing states to remain faithful to general norms, from which they are allowed to deviate only temporarily. In this manner, necessity can even contribute to the rule of law, thanks to its limited scope, constitutionalising emergency powers and subordinating them to pacta sunt servanda.

    Den moderna folkrätten har ett utstuderat system för ansvarsutkrävande när en stat svikit de plikter man åtagit sig i förhållande till andra stater. Inom statsansvarsrätten finns dock ett antal ansvarsfrihetsgrunder. En av de mer kontroversiella är den s.k. nödlägesinvändningen. Nödläge har kommit upp i ett antal intressanta internationella rättsfall under de senaste decennierna, bl.a. rörande åtgärder för att skydda miljön, humanitära interventioner och internationell terroristbekämpning. Trots att det fortfarande är ett kontroversiellt institut är det tydligt att stater under vissa omständigheter undgår ansvar för folkrättsbrott om de handlat av nöd. Frågan som diskuteras här är huruvida möjligheten att avvika från internationella åtaganden med hänvisning till ett nödläge kan vara skadlig för den internationella rättens utveckling. Staters tillit till internationella rättsregimer kan skadas och deras benägenhet att reglera sina mellanhavanden i traktatsform minska. Nödlägesinstitutet är dock starkt kringskuret i internationell praxis. Vidare medför det inte att beteendet är att anse som i sig lagligt. Nödläge kan därför i vissa avseenden utan större fara för den internationella rättsordningen utgöra en nödvändig säkerhetsventil.

    The application of Art. 87(1) EC to taxes above all is connected to the application of the derogation method, which appears to be part of the selectivity criterion. This dissertation examines the application of the derogation method and the assessment of the selectivity criterion applied to taxes, primarily de lege lata, but also de lege ferenda. It begins with an analysis of the relationship among the criteria of Article 87(1) EC and continues with an analysis of the relationship between the derogation method and the assessment of the selectivity criterion applied to taxes. Several scholars have criticised the application of the derogation method because of the difficulty of identifying a derogation and of establishing the benchmark against which the derogation should be assessed. In this dissertation both the benchmark and the establishment of a derogation is analysed, partly with reference to the tax expenditure debate that occurred in the subject area of international taxation during the 1970s and 1980s. The selectivity criterion applied to taxes contains an assessment of justification, whereby the selective nature of a measure can be justified on the basis of the nature or general scheme of the system: Therfore the meaning and implications of this assessment are also examined. After all these issues have been examined de lege lata, the extents to which the application of the derogation method and the assessment of the selectivity criterion follow a logical system are discussed and recommendations for eliminating the identified deficiences are put forward.

    Arbetet behandlar huruvida spekulationsköp av nyproducerade bostadsrätter är förenligt med bostadsrättslagens syfte. I arbetet kommer avtalsformer som ingås i samband med upplåtelse och överlåtelse av bostadsrätt att utredas. Detta dels för att se om avtalsformerna möjliggör eller förhindrar spekulationsköp samt, dels om dessa kan anses förenliga med nyttjanderättsformen bostadsrätt. Slutligen tas möjliga lösningsförslag upp hur ett minskande alternativt förhindrande av företeelsen spekulationsköp kan uppnås.

    Barn lär sig mer och mer engelska utanför skolan genom populärkultur. Syftet med

    denna studie är att undersöka hur populärkulturen förekommer i läromedel i engelska

    och på vilket sätt den förekommer. Även bakomliggande faktorer som Lpo94 och

    Lgr11 jämförs i analysen. Populärkulturens roll i skolan har förändrats genom åren och

    det är en central utgångspunkt i studien. Även hur populärkulturen kan användas inom

    andraspråksinlärningen samt som motivation är andra utgångspunkter. Genom en

    abduktiv metod skapas kategorier för olika typer av populärkultur som sedan studeras i

    fyra valda läromedel. Resultatet sammanställs kvantitativt och visade att kategorierna

    film, musik och sport var de som fick störst plats i läromedlen. Därefter följer en mer

    ingående analys av kategorin film och hur den uttrycker sig i läromedlen.

    Avslutningsvis visar det sig att populärkulturen definitivt fått en större roll i skolan än

    tidigare och att den accepteras på ett annat sätt. Denna studie är visar dock bara

    engelskämnet från läromedlens sida, inte hur populärkultur kan användas i andra delar

    inom engelskämnet.

    Molntjänster är aktuellt inom IT-området och spås skall komma att förändra sättet på vilket vi använder oss av datorer och internet. Fler och fler företag beslutar att köpa in sådana tjänster bland annat på grund av en kostnadseffektivisering av IT-hanteringen. I ett molntjänstavtal läggs grunden för vad som förväntas av köpare och säljare vid köp av molntjänster. På grund av den växande användningen av dessa tjänster och dess relativt nya intåg på marknaden har vi granskat två av de största aktörernas molntjänstavtal med syftet att identifiera och diskutera riskerna förknippade med avtalen. Utifrån de risker vi upptäckt ges därefter förslag till en blivande molnkund på överväganden som denna kan ha användning av vid avtalsskrivandet med en molntjänstleverantör.

    För att undvika olägenheter ger vi som förslag till en blivande molnkund att exempelvis svarstiden med fördel kan föras in i parternas avtal. Vidare bör kunden vara uppmärksam på leverantörens eventuella rätt till ensidiga ändringar i avtal och tjänst och kunden bör överväga vilka konsekvenser detta kan ha för dess företag samt i vilken utsträckning ändringar kan accepteras. Uppmärksam bör även den blivande kunden vara på de långtgående ansvarsfriskrivningar som leverantörerna gör då detta till viss del kan minska dess incitament att upprätthålla en hög servicenivå.

    De granskade avtalen var i stora drag relativt lika varför vi har anledning att tro att fler molnavtal ser ut på ett liknande sätt. Det innebär att de överväganden som diskuterats i samband med uppsatsens aktuella avtal, även torde kunna appliceras på andra molntjänsteavtal.

    Abstract [en]

    When a limited liability company’s (hereinafter company) shares become available for trading on a stock exchange or another trading platform, the company is obliged to prepare a prospectus. A prospectus constitutes information for a person to decide whether or not he is willing to invest in a company. For this reason, it is important that the prospectus does not contain any errors or other defects. In case it turns out that a prospectus contains errors or is deficient for another reason, the question arises if the injured party can obtain compensation from the company that has prepared the prospectus. In the Swedish stock market, as in many foreign stock markets, it is standard practice that securities institutions support a company that conduct an IPO by, for instance, subscribing or acquiring shares and then selling them to other investors. In order to insure against the risk that a prospectus contains inaccuracies, the involved securities institution normally requires that the company, which conduct the IPO, undertakes a financial liability in the event that this risk is realised and causing the securities institution financial loss.

    Repeatedly, it is discussed if companies may undertake liability to a securities institution, as a guarantee that a prospectus is not deficient, due to the fact that the securities institution is considered as a subscriber of share or a shareholder. Given that many are affected by this issue, since a large part of the Swedish population invests in the stock market directly or indirectly through pension funds, it is inconvenient that the legal situation is so uncertain with regard to if a corporation can be liable for having failed in its prospectus liability. Therefore, the intention of this paper is to find out whether a company, in existing law, can undertake a financial liability of corporate legal effect, against the securities institution, for having failed in its prospectus obligation. Further, the question if the current law is justified or if there is any reason to change the existing law is addressed.

    The general rule in the Swedish law is that companies can undertake financial liability based on the law of contract. Thus, it would be considered as an exception from the general civil provisions if companies cannot undertake a financial liability towards the subscribers of shares and shareholders. In this paper, it is concluded that in existing law there is nothing that supports that a company would be completely restricted from being able to undertake such a financial responsibility. However, in my opinion it indicates that practice restricts the scope of liability as a company may undertake.

    Abstract [en]

    This thesis suggests that it is reasonable to ask why we should try to give a general description of law. It attempts to turn our attention away from general descriptions of the law, to the approach that has made us present and use such descriptions. This shift of attention is suggested by the difficulties encountered in our attempts to agree upon any of the proposed descriptions. The thesis presents an alternative approach to law. With the alternative approach we must question the use of assuming that law is something we can describe in general terms.

    The alternative approach is also supported by a critique of some widely spread conceptions of meaning, truth and reality. By showing how a pragmatic conception of truth and reality can be consistent and how it helps us focus on the most relevant matters, these arguments offer additional reasons for the change of approach.

    This change can liberate practise of law from the grip of theorists trying to force law into a mould more appropriate in natural science. The use of theory and philosophy in law is strongly questioned and the frequent need for profoundly difficult judgements is acknowledged.

    Abstract [sv]

    Syftet med denna studie är att undersöka hur en utvald grupp gymnasieelever ser på begreppet hälsa. Studiens utgångspunkter är hälsobegreppets innebörd, dess plats i media samt i ämnet Idrott och hälsa. Hälsa är enligt vetenskaplig definition föränderlig och innefattar individens hela liv och livskvalitet. Studien bygger på sex intervjuer med gymnasieelever. Insamlat data har sedan transkriberats. Resultatet visar att synen på hälsobegreppet är relativt lik bland gymnasieelever, där fokus ligger på att må bra som person samt att vara fysiskt aktiv på den nivå som passar individen. Den mediala vinklingen av begreppet anses primärt vara kopplat till det yttre, där en smal och ungdomlig kropp idag anses vara idealet. Detta har enligt mina respondenter stor påverkan på ungdomar, som idag i stor utsträckning tränar och anpassar sin livsstil för att nå upp till dessa ideal, mycket på grund av viljan att passa in. Idrott och hälsa ses i samband med detta som en viktig kunskapsförmedlare gällande kritiskt tänkande mot den mediala vinklingen. Undervisningen anses gynna gymnasieelevers kunskaper om hälsobegreppet likväl de komponenter som utgör en hälsosam livsstil. Ämnets fokus anses vara processen gällande det psykiska och fysiska välmåendet, i motsats till det slutgiltiga målet som presenteras inom media. Detta anses i sin tur utveckla mina respondenters syn på begreppet samt det kritiska bemötandet av den utseendefixering som finns i bland annat media och sociala medier.

    Den 25 maj 2018 ersätts personuppgiftslagen (1998:204) (PuL) av dataskydds­förordningen (General Data Protection Regulation; GDPR).

     

    Syftet är att modernisera reglerna som följer av dataskyddsdirektivet från 1995 och få till stånd en mer enhetlig tillämpning, inom EU. På många områden stärks de registrerades rättigheter. Skyldigheterna ökar eller blir förtydligade för person­uppgiftsansvariga.

     

    Implementeringen av de nya dataskyddsreglerna får konsekvenser för person­uppgiftsansvariga och personuppgiftsbiträden. För många handlar det om ett stort arbete med förberedelser. Anpassningarna leder otvivelaktigt till kostnader för personuppgifts­ansvariga och den tid och resurser som krävs kan försena andra utvecklingsprojekt. De nya reglerna om administrativa sanktionsavgifter får stor inverkan på personuppgifts­ansvariga.

     

    Det finns också positiva effekter av GDPR, såsom ett ökat skydd för den värdefulla kunddatabasen. Det är viktigt att värna om kundernas förtroende, och en seriös integritetspolicy har betydelse. GDPR bidrar till att skapa och upprätthålla detta förtroende, genom klar och tydlig information och öppenhet. Vid en framtida försäljning av verksamheten har kunddatabasen, konton etc. ett värde; alltså gäller det att skydda den tillgången.

     

    I uppsatsens analys av skillnaderna mellan PuL och GDPR får vi följa en case study, där ett företag är mitt uppe i ett pågående GDPR-projekt. Vi får ta del av tolkningar och anpassningar till de nya reglerna. Uppsatsen avslutas med ett förslag på hur person­uppgiftsansvariga kan förbereda sig inför en lyckad anpassning till GDPR.

    Abstract [en]

    This study examined how five school counselors articulates the most common problems students they meet contend with and studied the factors that obstruct school welfare to their job of being available for students. The study’s main questions are how the school counselors looks at students’ mental illness, how school counselors prevent mental illness as well as the obstructions that the counselors contend with. The methodology for this study is qualitative interviews and participatory observation. The theoretical basis of this study are the children’s perspective, social support and role theory. The result shows that school counselors felt that most students generally had a great mental health and that they had the basis for wellbeing. However the issues that school counselors noticed are among depression, performance anxiety and loneliness, where loneliness are the main problem among students. School counselors suggests that loneliness is not due to bullying, the reason to loneliness among students are often lack of social competences. The result suggests that the school counselors’ availability is important to improve students’ mental health. School counselors’ main tool to achieve mental health among students are their social support, but they need time and resources to succeed, which most school counselors feels is a limitation for them.

    Abstract [en]

    This study aims to investigate how participants in a companys traineeprogram describe that the programmes educational tasks has prepared them for their future work. The study also examines how participants perceive that they have developed skills that are specifik to their profession and how they became part of a community. The following questions were formed to make it possible to investigate the purpose further; ”Do the participants feel that the interaction within the trainee group has promoted their learning?”, ”How does the participants describe the training elements in relation to their development of competencies that they use in their professional role?” and ”How does the traineeprogram contribute to the participants becoming part of a community?”. This was examined by taking part of what previous research has highlighted as important for learning and socialization in relation to traineeprograms. Seven semi-structured interviews were conducted with employees of a company in the private service sector. The empirical data was analyzed based on theories of socio-cultural learning. The results show that participants in the traineeprogram early on are able to interact with many different people who work in the company. The training elements consists of both theoretical and practical education, which means that participants receive a broad knowledge that they need to face their future careers. Participants in the traineeprogram also feel that the ability to interact with others within the trainee group has promoted their learning both during training and it is something that they can use after graduation.

    Abstract [en]

    The precautionary principle has evolved from the recognition that scientific certainty often comes too late to design effective responses for preventing environmental threats. In article 15 of the Rio Declaration it is defined as:

    Where there are threats of serious or irreversible damage, lack of full scientific certainty shall not be used as a reason for postponing cost-effective measures to prevent environmental degradation.

    The precautionary principle is getting more widespread in international law. The next step is to increase and improve national implementation. Thus, the purpose of this thesis has been to analyse how the precautionary principle can be implemented into national environmental law, and what the main factors influencing the success of national precautionary actions and measures are.

    The main content of this thesis includes:

    · Analysis of how the precautionary principle has been implemented in Swedish environmental legislation and used for phasing out chlorofluorocarbons (CFCs) in Sweden.

    · An identification and analysis of main factors influencing the success of national actions and measures based upon the precautionary principle, including political and economic factors, factors related to research, information and technology, and legal and organisational factors.

    In democratic societies, freedom of expression is the indispensable right and duty of citizens. Although there are a few exceptions, it is generally considered that governments should not intervene and regulate this right. Both in digital and analog environments, sexual and violent descriptions are usually regulated by self-censorship of participants. However, trying to protect minors from potentially harmful contents by controlling and regulating them is very difficult. The definition of what is “potentially harmful contents on minors” varies depending on the values and on the culture of each social group. Moreover, along with the rapid spread of mobile phones and smartphones, it becomes more difficult for parents and teachers to control children’s access to harmful contents; something that might have been easier regarding the use of personal computers. Access to the Internet provides huge opportunities not only of visiting websites but also of participating in online communication such as Social Networking Service (SNS). An incredible surge of SNS evokes some issues in considering juvenile access to SNS, categorized roughly into three types. One is the very old and new problem in accessing the Internet, which is how to shield minors from harmful contents. Second is how to block inappropriate contact with a pedophile. Third is cyber bullying. SNS is a very new medium and its market and technology are evolving drastically and are constantly changing. Thus the agent of taking the lead in making and enforcing rules or self-regulation is still absent. Additionally, SNS services utilize the function of social graph actively, and third parties can provide contents and applications using open API. In response to these situations, European Commission implemented Safer Social Networking Principle for the EU, and United States released the guideline for SNS users and worked on SNS companies and users to promote voluntary efforts for using SNS properly. In Japan, mobile contents companies built the Content Evaluation and Monitoring Association (EMA) as a voluntary reviewing entity. However those measures don’t include any severe legal penalty. Those remain self-regulation relying on voluntary activities of private sectors. On the other hand, self-regulation itself is regulated by laws, social norms, market conditions and technological architectures. In this paper we discuss the conditions of regulation and self-regulation, and we explore some ideas about what would be the best way to regulate SNS.
