    Principles of European Family Law Regarding Property Relations Between Spouses2013Book (Refereed)
    Abstract [en]

    This book containts the fourth set of European Principles on Family Law, elaborated by the Commission on European Family Law since early 2000s, now with the focus on the property relations between spouses.  The Principles are based on comparative studies between 26 jurisdictions in Europe. Regard is also had to international instruments in the field. The Principles aim to identify and promote such solutions that fit the current European societies, which contribute to free mobility in Europe and which the research group has found suited as the basis for harmonisation of law in Europe.

    Abstract [en]

    With the Boll-case as the starting point, decided by the International Court of Justice in 1958, the contribution analyzes subsequent legal cooperation across frontiers to protect children against detrimental family environments. Special attention is given to Dutch and Swedish case law, the 1996 Hague Convention, the EU's Brussels II bis Regulation and the case law of the EU Court. The authors conclude that European children, indeed, are somewhat "better off" with the two new international instruments, inspite of the difficulties experienced on a national level regarding how to interpret and apply these instruments.

    I denna populärvetenskapliga skrift, som utgör Söderbergska prisanförandet 2013, används de rättsliga problem som Ingrid Bergmans relation med den italienske filmregissören Roberto Rossellini gav upphov till som illustration för vad den internationella familjerätten handlar om.  Det dåvarande rättsläget jämförs med det rådande i Europa, tack vare EU:s harmoniserande aktiviteter inom lagstiftning. Det sätts dock i fråga att en sådan situation som Ingrid Bergman råkade ut för, skulle kunna lösas smidigt med hjälp av EU-reglerna.

    The article offers an overview of the developments in Swedish family law 2014-2015. Discussed issues include: The EU's Succession Regulation and its implementation into Swedish law, Sweden's plan to implement the UN Convention on the Rights of the Child as directly applicable law, improved protection of vulnerable adults and law reforms aimed to improve access to assisted fertility treatments within the Swedish health care system, in particular single women's right to insemination.

    Artikeln analyser det pågående paradigmskiftet inom den internationella privaträtten från ett nationellt regelsystem till en europarättslig reglering. Beslutsfattande inom EU på det familjerättsliga området analyseras. Artikeln illustrerar de uppenbara svårigheter som de nya EU-reglerna inneburit för svenska domstolar, inom gränsöverskridande familjerättsmål. EU-domstolens tolkning har i flera fall inte motsvarat Sveriges förväntningar.

    Abstract [en]

    This chapter provides a thorough analysis of the changed legal landscape of family law in Europe, as a result of the European Union's legislative activities. Special attention is given to cross-border family relations. The Lisbon Treaty creates new challenges.  The nation-states' legislative autonomy is increasingly reduced. Whereas legal coherence may increase on a pan-European level, it has decreased on the national level.

    Abstract [en]

    This article draws attention to the cross-border implications of Ingrid Bergman's three marriages and their dissolutions. Ingrid Bergman (b. 1915) can be regarded as Sweden's internationally most celebrated  film star and actress, ever (beside Greta Garbo). Her often turbulent family life crossed national borders and gave rise to difficult legal problems which could be solved only by the creative and, occasionally, questionable use of Private International Law. She obtained, e.g., a migratory divorce from her first husband (Petter Lindstrom) in Mexico, where she also concluded a proxy marriage with the Italian film director Roberto Rossellini, in evasion of the laws of Sweden, Italy and the United States. The "flavour" of morality and the impact of religion has, afterwards, decreased in European family law, facilitating life for all Europeans.

    Internationella familjerättsfrågor har sedan slutet av 1950-talet varit föremål för samarbete inom EG/EU. En ny fas inleddes genom Amsterdam-fördragets ikraftträdande. Gemensamma regler (förordningar) planeras beträffande alla sådana frågor som kan anses ha betydelse för den fria rörligheten av personer inom unionen. Denna utveckling är inte enbart positiv för Sveriges del. Utrymmet minskar inte bara för nationell, till det svenska samhället och den svenska familjerätten anpassad lagstiftning, utan även för internordiskt och globalt samarbete. För att Sverige inte skall riskera regler som innebär ett stort steg tillbaka i förhållande till vår gällande internationella familjelagstiftning, bör vi bl.a. slå vakt om en snäv tolkning av den inre marknadens behov i sammanhanget.

    Abstract [en]

    The article provides a compehensive analysis of the European Union's Brussels II bis Regulation in respect of divorce. The Regulation's rules on jurisdiction and recognition of judgments on divorce are analyzed and exemplified. The article is critical towards the need of any unified choice of law rules regrading divorce. Finally, the article focuses on the so-called foreign law problem, which should be given far more attention within the EU also in the field of divorce law.

    This article analyzes the challenges of polygamous marriages in a global society, with special regard to Sweden. It is argued that "imported" polygamous marriages should under certain circumstances be recognized in Sweden. The contrary dimensions of human rights protection are discussed.
