Note

This essay critically discusses the use of the prefixes “liberal” and “illiberal” before the word “democracy”. It is claimed that there has been a “liberalization” of the concept of democracy in a double sense. Firstly, what has usually been called democracy (without a prefix) is now often referred to as “liberal democracy”. Secondly, defective democracies in which democratic freedoms and rights are restricted have been called “illiberal democracies”. This conceptual shift implies that the conventional distinction between democracy and liberal constitutionalism becomes blurred. Both democracy and liberalism have been drained of some of its core principles, and this has been exploited by authoritarian populists who oppose both. In an analysis of Robert Dahl’s conception of democracy, it is argued that it is misleading to call him a “liberal democrat”. According to Dahl, democratic freedoms and rights are internal to democracy as such, and should not be confused with liberal rights that are typical for liberal constitutionalism.

Abstract [en]

This short paper focuses on the relationship between the procedural and the epistemic arguments for democracy in David Estlund’s epistemic proceduralism. It is argued that his theory could be purely epistemic, in the sense that it justifies democracy only from its ability to ascertain and implement an independent standard of correctness. Obedience to wrong decisions (within certain limits) – in epistemic as well as in non-epistemic cases – can be justified in terms of prospective concern for the epistemic (and moral) capacity of democracy. There is no need for a procedural justification of democratic political authority and legitimacy.

Abstract [en]

This article investigates three ideas that have had a hegemonic position during the formative period of the majoritarian model of democracy: (1) Value Relativism of Axel Hägerström, (2) Tingsten’s procedural concept of democracy, and (3) Jörgen Westerståhl’s popular-will theory of democracy. These three ideas are often believed to give support to a kind of moral subjectivism that is hostile to constitutionalism. An abstract conceptual analysis is combined with a more historical approach focused on the impact of these ideas through different normative interpretations. The conclusion is that neither Value Relativism (and the associated Scandinavian legal realism), nor the procedural concept of democracy has any anti-constitutional implications. The popular-will theory of democracy, on the other hand, has a stronger theoretical link to anti-constitutional ideas.
