Abstract [en]

Belgium is a small but complex country with an interesting and uniquelegal culture. It lies on the historical vault between Germanic and Romanic Europe, as a result of which the country has three different languages (respectively Dutch andGerman versus French) and two main populations, Flemish and French-speaking Belgians. Originally a unitary state, Belgium has transformed into a federal state through successive state reforms, with the new Constitutional Court as an arbiter between the different entities, which are all equal and without hierarchy. This in its turn has resulted in two emerging subcultures that are slowly but steadily drifting apart. Internationalization and Europeanization are adding some layer to the already complex mosaic of cultural diversity in this small jurisdiction at the very centre of Europe. Historically and as an offspring of the French legal culture, the Belgian legalculture is a civil law system with a set of (originally Napoleonic) codifications and a rational judicial system. The organization of the judiciary and the application of lawsin many ways reflect the ideal of law and justice in Belgium: accessible, tailor-made, specialized, and sufficiently flexible to include considerations of individual justice, with the necessary checks and balances. Just like the French legal culture, the Belgian legal culture is strictly legally positivistic and has a high degree of professionalization.

Abstract [en]

AbstractIn the 16th century, Joos De Damhouder (1507-1581) engaged in plagiarism by drawing extensively from the writings of his compatriot Filips Wielant (1439-1519). This remained obscure for several centuries, affording De Damhouder the opportunity to establish an international reputation as a preeminent legal scholar, whereas Wielant’s contributions languished in relative obscurity. However, in the latter half of the 19th century, scholars succeeded in unearthing the plagiarism, igniting considerable controversy and scholarly discourse on the matter. This revelation had profound repercussions, leading to a tarnishing of De Damhouder’s once-pristine reputation. Subsequent generations of legal historians undertook investigations into this matter. In recent years, a nuanced reevaluation of De Damhouder’s standing has transpired.

Abstract [sv]

Under hösten 2019 anordnades på Juridiska institutionen en doktorandkurs i rättshistoria för doktorander i juridik. Kursens huvudsakliga syfte var att presentera rättshistorieämnet ur olika infallsvinklar. Presentationerna gav en överblick olika metodologiska inriktningar som rättskultur, rättsgenetik och komparativ rättshistoria. Ambitionen var även att ge en rättshistorisk bakgrund som hade relevans för de olika juridiska forskningsprojekt som var representerade bland kursdeltagarna. I kursen deltog 16 doktorander som hade i uppgift att i en kortare uppsats presentera de rättshistoriska inslagen i sin respektive forskning och lägga fram den för diskussion. I föreliggande publikation presenteras förutom en inledande redogörelse för doktorandkursen sex bidrag som ur ett svenskt rättshistorisk perspektiv är de mest relevanta. Ett bidrag är författat av en doktorand i rättshistoria (Richard Nordqvist) medan övriga fem har författats av doktorander i positivrättsliga ämnen. De senare bidragen har ett särskilt intresse, då de innehåller rättshistorisk forskning som annars riskerar att hamna utanför rättshistorikernas omedelbara krets. Kursen organiserades av universitetslektor Bruno Debaenst och doktorand Rawaz Shanagar, Uppsala, och finansierades av Institutet för rättshistorisk forskning.
